When you file for Chapter 7 or Chapter 13 bankruptcy, an automatic stay goes into place. This automatic stay requires that all creditor actions against you stop, including foreclosure actions.
In order to ensure the automatic stay remains in place and the foreclosure process does not proceed, a solution needs to be found to the larger problem of catching up and staying caught up with your mortgage payments. Various options may exist, depending on your specific circumstances. I will discuss those options and help you find the solution that's right for you.
One option is loan modification, which can be used to help make mortgages more manageable. If need be, I can act as an intermediary with the mortgage company when seeking a modification. Sometimes Chapter 13 may be the better option because it allows you to create a repayment plan.
