What Can I Expect in Bankruptcy?

Learn About the Bankruptcy Process

The first step in the bankruptcy process is determining if bankruptcy is right for you. I am attorney Kenneth C. Ackerman, and I can help you with this critical step and all other steps that follow until you obtain the debt relief you seek.

To determine if bankruptcy is right for you, and which chapter of bankruptcy should be filed, a thorough review of your situation is necessary. This review will require the following pieces of information:

  • Tax returns from the last two to four years
  • Copies of your most recent credit reports
  • Copies of your most recent credit card, mortgage and other statements
  • Copies of correspondence from creditors
  • List of all regular recurring expenses, such as rent or mortgage, car payments and food
  • List of all debts, including credit card debts, medical bills and student loans
  • List of all personal property

If bankruptcy is the right step, you will first be required to take a consumer credit counseling course. After you have completed this course, bankruptcy can be filed. I will prepare all of the necessary documentation and file on your behalf.

After Bankruptcy Is Filed

Your road to a financial fresh start begins within 30 days of filing bankruptcy with a meeting of creditors. This meeting allows creditors to ask questions about your financial situation and why you are filing bankruptcy. More often than not, your creditors will not show up for this meeting. You will have to, and I will attend as your representative.

If you filed Chapter 7 bankruptcy, your debts will be discharged in half a year or less. That's how soon you can have the fresh start you need.

If you filed Chapter 13 bankruptcy, your debt repayment plan will last three to five years. Debt remaining after that time will be discharged. I will remain available to you throughout that time period, ready to act if something changes and the repayment plan must be revisited.
